Any mention of ‘Form Fun Function’, ‘our’ or ‘we’ refers to ‘Form Fun Function Limited’ and any reference to ‘you’, ‘your’, or the ‘client’, refers to the entity who is requesting the work outlined in this quote, or who is named in the quote.
It is not necessary for you to have signed a written acceptance of these terms and conditions for them to apply. By engaging Form Fun Function for any of the services outlined in this quote, it implies you understand and accept the following.
Unless otherwise agreed upon in writing, all projects require one of the two following payment schedules.
Schedule 1: An advance payment of 10% of the total quoted amount has to be made, before any work is supplied to you. Subsequent progress payments will be invoiced on a monthly basis, for the work completed the month prior.
Schedule 2: We’ll require a 50% deposit of the total quoted amount which is to be paid before we undertake any work. The remaining 50% will be invoiced once the project has been completed (e.g. the website has gone live). In the case of delays to the agreed project timeline, we may invoice up to 90% of the total quoted amount for delays lasting at least 2 months. In that case on completion only the remaining amount would be invoiced.
All payments are due within 7 days unless otherwise agreed upon by Form Fun Function.
We require payment to be made by bank transfer only. We are unable to accept EFTPOS or credit cards as a method of payment.
If payment is not made by the due date, you will be liable to pay a collection fee of 10% of the amount outstanding. If in an extreme case your due amount remains outstanding, we will pass your account to a debt collection agency. Please be aware you will be liable to cover any costs incurred in the debt recovery process including commission and legal costs. We also reserve the right to halt any services we provide to you in the event of an unpaid account.
We will transfer ownership of the final product to you upon full payment of the quoted amount. In addition, by accepting this quote, you provide Form Fun Function with the right to use the product, or visual representations of this product for promotional purposes. You also provide Form Fun Function rights to reuse, distribute, and modify any source code, scripts, methodologies or processes created as a result of this project.
Concepts, samples, design proofs or anything submitted during the developmental stages remain our property and are not considered part of the final product under the scope of this quote.
Some software, code or other parts of this product may be governed by their own licensing agreements, in which case the ownership terms outlined in those agreements may apply.
Any product or service provided to you is to be used for lawful purposes only, under New Zealand law, and in whichever country or territory the products or services are intended to be used. Form Fun Function accepts no responsibility for claims made as a result of damages or harm from use of products or services we have provided to you.
By conducting business with Form Fun Function, we may use your email address provided for occasional marketing emails and updates. You may choose to opt out of these email updates at any time.
You may supply personal or confidential information for the purposes of providing services to you. We will only use that information for purposes made clear to you, including occasional marketing communication and will not share this information with any third party without your consent. At any time, you have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is incorrect. If you would like to ask for a copy of your information, or to have it corrected, please contact us at [email protected].
All front end code provided in connection with the services outlined in this quote, will be tested in the most recent versions of Internet Explorer, Edge, Firefox, Chrome, Safari, iOS Safari and Chrome for Android. It will also be tested at common screen resolutions for desktop, tablet and mobile devices. Any website provided by Form Fun Function will be developed with the intention to support browsers which are ECMAScript 5 compliant. A full list of browsers can be seen here https://caniuse.com/#feat=es5. We will repair any issue found on your website which presents itself in an ECMAScript 5 compliant browser within the first 3 months of the live date. Any subsequent maintenance of your website is not covered in the scope of this quote.
We are not responsible for any bug or issue with your site that causes damage, loss of business or harm. We also provide no guarantee your website will be free of bugs or issues upon going live.
